PIT 36 or PIT 38 declaration form?
According to the tax authorities, there are at least two ways to settle the tax income (PIT): through PIT 38 and PIT 36 declaration form.
However, the opinions on the proper declaration are different and the tax offices themselves are not in agreement as to which group the profit from social loans should qualify for. Due to the fact that there is no unambiguous interpretation that would impose an obligation to stick to one of these forms, the final decision belongs to the Investors.
For our part, we suggest submitting the PIT-38 declaration form and, if need be, contacting the local tax office.
